1. GENERAL CONDITIONS

LuxBerri (LB) is a transport service company located at 40 Rue du Colisée, 75008 Paris, France, registered under the number 910567817 R.C.S. LB allows its users to book transportation services through its proprietary online digital platform. LB's service consists of arranging transportation for users by independent ride service providers (Véhicule de Transport avec Chauffeur, "VTC"). LB facilitates these business services on behalf of the users.

These General Terms and Conditions form an integral part of every agreement between the user and LB regarding the arrangement of business service contracts. They also outline the specifics of the transportation services, granting the user a direct claim against a particular VTC.

Any conflicting terms and conditions proposed by the user are expressly rejected, including those outlined in confirmation letters or services accepted without reservation. Such terms will only apply if LB has provided explicit written consent to them.

2. RIDES TYPES AND SERVICES

Depending on availability, the user can select ride requests that include Paris city rides, long-distance rides (in France), and bordering countries rides (only departure from Paris for bordering countries rides).

3. BOOKINGS

Reservations can only be made via our company website, www.luxberri.com. Two types of reservations are available: transfer bookings and hourly bookings. Transfer bookings include airport transfers, city-to-city transfers, and train station transfers. Other reservations will automatically be included in hourly bookings.

4. CRITERIA TO BE CONSIDERED WHILE BOOKING

4.1 Pickup information and Vehicle choice

  • The addresses of pickup and drop-off points must be clearly specified.
  • When selecting a vehicle, please consider the following criteria: number of passengers, amount of luggage, and class of vehicle (Business class, Business Van/SUV, or Luxury class).

4.2 Extra luggage

4.2.1 Extra luggage, such as a wheelchair, weapons, pets, or any equipment the user wishes to carry, must be specified in the note box during the booking. We can’t accept oversize luggage, bicycle boxes, large snowblades, large skyboard, windsurf board etc.

4.3 Pickup time

  • 4.3.1 The agreed pickup time is the time specified in the LB booking confirmation.
  • 4.3.2 For airport or train station pickups, users must provide the correct flight or train number in the note box on the website. This will help us track the arrival time of the flight or train.
  • 4.3.3 An hourly booking begins at the scheduled pickup time and location. The booking includes up to 20 km of travel per hour (e.g. a 5-hour booking allows up to 100 km). If the ride exceeds the allotted kilometres or surpasses the booked duration, additional fees may apply.

4.4 Stopovers

4.4.1 Stopovers are only applicable for long-distance rides, not for transfer rides. If additional stopovers are requested, an extra fee may be incurred according to the applicable price schedule.

4.5 Transport of children / minors and their needs

  • 4.5.1 The transport of unaccompanied minors may be rejected by LB. The determination of minor status will be carried out in accordance with the legal provisions of the region in which the transport is to be performed.
  • 4.5.2 The need for child restraints must be specified in the note box by indicating the number and age of the children to be transported, as well as the type of child restraints required. LB will prepare baby seats and boosters accordingly.
  • 4.5.3 If baby seats or booster seats are needed, please specify this in the note box.

5. TRANSPORT OF ADDITIONAL BAGGAGE OR PASSENGERS

If our users have brought additional baggage or passengers compared to those specified during the reservation, LB may refuse to transport these passengers or baggage if, in its opinion, the space and security conditions do not permit such transport.

6. WAITING TIME

For transfer rides, no surcharges will apply for waiting times of up to 60 minutes for pickups at airports, up to 30 minutes for pickups at train stations, and up to 15 minutes for all other pickups from the agreed time. Any additional waiting time will be charged based on a proportion of the hourly booking rates applicable in the relevant city area and for the respective vehicle class.

7. CANCELLATION

For transfer rides, long-distance rides, and hourly bookings, cancellation is free if done more than one hour before the agreed pickup time. If the cancellation is made one hour or less before the pickup time, the full price must be paid. Effective cancellations must be made using the cancellation function on the website or via WhatsApp.

8. BEHAVIOR IN THE VEHICLES

  • During the entire ride, current road traffic rules and regulations must be followed, including the obligation to wear a seat belt.
  • Users must always follow LB's instructions.
  • LB is responsible for safely completing the ride. Therefore, guests are prohibited from opening doors during the ride, throwing objects out of the vehicle, hanging any part of their body out of the vehicle, or screaming from the vehicle.
  • If users cause damage to the vehicle with sharp-edged objects, they must bear the cost of repairs.
  • Smoking is prohibited in the vehicles. If this rule is ignored, the user must bear the cost of cleaning the vehicle and any resulting loss of functionality.
  • The consumption of food is not recommended. Alcoholic beverages are only allowed with prior consent.

9. OBJECTS LEFT BEHIND

Users can contact us via WhatsApp regarding objects forgotten in the vehicle, but LB assumes no liability for such items.

10. PAYMENT MODALITIES AND TRANSACTION FEES

Users can pay for a ride by credit card. Any credit card fees incurred are the responsibility of LB. Users are responsible for any transaction costs when paying by transfer (e.g., due to currency differences or local accounts).

11. WARNING NOTICES, FAILED CREDIT CARD DIRECT DEBITING

For each payment warning notice, LB may charge a reasonable reminder fee. In the event of failed credit card debit authorizations, LB will charge the user for the expenses incurred in connection therewith (bank, credit card institution) and reserves the right to charge a reasonable processing fee per incident.

12. INVOICES

LB can send the applicable invoice by Email to the user account. If payment is made by credit card, the applicable compensation is due for payment immediately. If payment is made by bank transfer, the payment term referred to in the invoice shall be applicable.

13. THIRD-PARTY WEBSITES

LB accepts no responsibility for the content, freedom from error, legality, and functionality of third-party websites referred to by means of links. Links are accessed at your own risk.

14. FINAL PROVISIONS

14.1 ENTIRE AGREEMENT, WRITTEN FORM

These General Terms & Conditions constitute the entire agreement between LB and the user for the contractually agreed services. No warranty agreements are included. Modifications and additions to this Agreement must be made in writing to be valid.

14.2 APPLICABLE LAW, COURT OF JURISDICTION

The law of the Federal Republic of France applies to all legal relations between LB and the user.

14.3 INFORMATION ON ONLINE DISPUTE RESOLUTION

The EU Commission has an Internet platform for the online settlement of disputes (referred to as the "OS platform"). The OS platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts or online service contracts. 14.4 SEVERABILITY CLAUSE

Should individual provisions of these T&Cs be or become ineffective, unenforceable, or contain gaps, the remaining regulations will remain effective. The parties undertake to replace the ineffective, unenforceable, or missing provisions with those that most closely approximate the meaning and economic purpose as intended by the parties.
